The Qadim Group, Inc. (“TQG,” “we,” “us,” or “our”) operates https://www.theqadimgroup.com and Qadence by TQG™ (“Qadence”) (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, communicate with us, or use Qadence. We process personal information as described in this Privacy Policy and as otherwise permitted or required by applicable law. Where consent is required by law, we will obtain consent as appropriate. Your use of the Services may also be governed by applicable terms of service, customer agreements, data processing agreements, or other contractual terms between TQG and you or the organization through which you access the Services.
2. Definitions
SERVICE means the https://www.theqadimgroup.com website, Qadence by TQG™, and related services operated or provided by The Qadim Group, Inc.
PERSONAL DATA means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).
USAGE DATA is data collected automatically either generated by the use of Service or from Service infrastructure itself (for example, the duration of a page visit).
COOKIES are small files stored on your device (computer or mobile device).
DATA CONTROLLER means the person or organization that determines the purposes and means of processing Personal Data.
DATA PROCESSOR means a person or organization that processes Personal Data on behalf of a Data Controller.
TQG may act as a Data Controller for Personal Data we collect directly for our own business purposes, such as website, account, contact, billing, security, and business relationship information. Where we process Personal Data through Qadence on behalf of a customer, that customer generally determines the purposes and means of processing and TQG acts as a Data Processor or service provider on the customer’s behalf, subject to the applicable customer agreement.
DATA SUBJECT is any living individual who is the subject of Personal Data.
THE USER is the individual using our Service. The User corresponds to the Data Subject, who is the subject of Personal Data.
3. Information Collection and Use
We collect several different types of information for various purposes to provide and improve our Service to you.
4. Types of Data Collected
Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Depending on how you interact with us, Personal Data we collect directly may include:
(a) name and business contact information, including email address and telephone number;
(b) organization, job title, and account information;
(c) billing, transaction, and contractual information;
(d) authentication, access, and security-related information;
(e) communications and support requests you send to us; and

Qadence customers may also provide or make available information for processing through the Services. The nature of that information is determined by the applicable customer and its use of the Services.
Usage Data
When you access the Services, we may automatically collect technical information such as Internet Protocol (IP) address, browser type and version, device and operating system information, pages or features accessed, timestamps, referring pages, session information, diagnostic data, and other information used to operate, secure, troubleshoot, and improve the Services.
Tracking Cookies Data
We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Legal Bases for Processing
Where the GDPR, UK GDPR, or similar law applies and TQG acts as a Data Controller, we process Personal Data on one or more of the following legal bases:
(a) performance of a contract or taking steps at your request before entering into a contract;
(b) TQG’s legitimate interests, including operating, securing, supporting, and improving the Services, managing customer and business relationships, and preventing fraud, misuse, and security incidents, where those interests are not overridden by your rights and interests;
(c) compliance with legal obligations; and
(d) consent, where we request and rely upon your consent.
Customer Data Processed on Behalf of Customers
Customers may submit, connect, upload, or otherwise make data available to Qadence and related services. Where such data includes Personal Data and TQG processes it on behalf of a customer, TQG processes that information according to the customer’s instructions, applicable contractual terms, and any applicable data processing agreement.
Individuals seeking to exercise rights regarding Personal Data controlled by a TQG customer should generally contact that customer directly. Where appropriate, TQG will assist customers in responding to such requests.
6. Retention of Data
We retain Personal Data only for as long as reasonably necessary for the purposes for which it was collected, including to provide the Services, meet contractual commitments, comply with legal and regulatory requirements, maintain appropriate business and security records, resolve disputes, and enforce agreements. Retention periods may vary depending on the nature of the information and the context in which it is processed.
Customer Data processed on behalf of customers is retained and deleted in accordance with applicable customer agreements, documented instructions, and TQG retention and deletion procedures.
Usage Data is generally retained for a shorter period unless longer retention is necessary for security, functionality, legal, regulatory, or contractual purposes.
7. Transfer of Data
Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. Personal Data may be processed or stored in countries other than the country in which it was originally collected, including the United States and Canada, and may also be processed in other jurisdictions where TQG or its service providers operate. Where required by applicable law, we use appropriate safeguards for international transfers of Personal Data.
For customer-controlled data, applicable hosting locations and transfer arrangements may also be governed by the customer agreement or data processing agreement.
8. Disclosure of Data
Service Providers. We may disclose Personal Data to vendors, cloud hosting providers, authentication providers, analytics providers, professional advisers, and other service providers that process information on our behalf or assist us in operating and securing the Services. These providers are permitted to process Personal Data only for authorized purposes and subject to appropriate contractual or legal obligations. We may disclose personal information that we collect, or you provide:
(a) Disclosure for Law Enforcement.
Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.
(b) Business Transaction.
If we or our subsidiaries are involved in a merger, acquisition or asset sale, your Personal Data may be transferred.
(c) Other cases. We may disclose your information also:

Where TQG processes Personal Data on behalf of one of our customers, the customer is generally responsible for responding to data subject requests. If you submit such a request to us, we may direct you to the applicable customer or forward the request as appropriate.
In certain circumstances, you have the following data protection rights:
(a) the right to access, update or to delete the information we have on you;
(b) the right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete;
(c) the right to object. You have the right to object to our processing of your Personal Data;
(d) the right of restriction. You have the right to request that we restrict the processing of your personal information;
(e) the right to data portability. You have the right to be provided with a copy of your Personal Data in a structured, machine-readable and commonly used format;
(f) the right to withdraw consent. You also have the right to withdraw your consent at any time where we rely on your consent to process your personal information;
Please note that we may ask you to verify your identity before responding to such requests. Please note, we may not able to provide Service without some necessary data. Where applicable, you have the right to lodge a complaint with the data protection or supervisory authority responsible for data protection in your jurisdiction.
11. California Online Privacy Protection Act (CalOPPA)
The California Online Privacy Protection Act (“CalOPPA”) requires certain operators of commercial websites and online services that collect personally identifiable information from California consumers to provide specified privacy disclosures.
Do Not Track. Some browsers provide a “Do Not Track” (“DNT”) signal. Because there is not currently a universally accepted standard for responding to DNT signals, our Services do not presently respond to browser DNT signals unless required by applicable law.

We do not permit third parties to use the Services to collect Personal Data for their own cross-context behavioral advertising purposes unless expressly disclosed.

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), provide Service on our behalf, perform Service-related services or assist us in analysing how our Service is used. These providers may process Personal Data as necessary to provide contracted services to TQG and are subject to contractual, confidentiality, security, and data-protection obligations appropriate to the services they provide.

We may use third-party Service Providers to monitor and analyze the use of our Service.

14. CI/CD tools
We may use third-party Service Providers to automate the development process of our Service.
GitHub. We use GitHub for software development, source-code management, and related development operations. GitHub’s processing of information is governed by its applicable privacy terms.
15. Payments
We may provide paid products and/or services within Service. In that case, we use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

16. Third-Party Service Providers and Subprocessors
TQG uses third-party providers to support hosting, authentication, infrastructure, analytics, communications, development, security, and other business functions. The providers used for a particular service may vary depending on the service, customer configuration, and hosting environment.
Where TQG processes Personal Data on behalf of customers, applicable subprocessors are subject to appropriate contractual and security requirements. Additional information regarding subprocessors may be made available to customers upon request or through applicable contractual documentation.
17. Links to Other Sites
Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
18. Children's Privacy
The Services are intended for business and professional use and are not directed to individuals under 18 years of age. We do not knowingly collect Personal Data directly from children through the Services.
